By accessing or using PsyLoops ("Platform," "Service," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Platform.

2. Description of Service

PsyLoops is a digital marketplace and platform that provides:

  • Royalty-free music samples and sound packs
  • AI-powered music production tools
  • Professional audio services (mastering, mixing, production)
  • Educational content and mentoring
  • Community features for music creators

3. Account Registration

3.1 Eligibility

You must be at least 18 years old to create an account. By registering, you represent that you meet this age requirement.

3.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access

3.3 Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

4. Subscriptions and Payments

4.1 Subscription Plans

We offer customized subscription plans with different features based on your needs. Subscription fees are billed in advance on a recurring basis as agreed upon.

4.2 Payment Terms

  • All fees are non-refundable unless otherwise stated
  • Prices are subject to change with 30 days notice
  • You authorize us to charge your payment method automatically
  • Failed payments may result in service suspension

4.3 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. You will retain access to paid features until that date.

5. User Content and Conduct

5.1 Your Content

You retain ownership of content you upload. By uploading, you grant us a worldwide, non-exclusive license to use, reproduce, and distribute your content on our Platform.

5.2 Prohibited Content

You may not upload or share content that:

  • Infringes on intellectual property rights
  • Contains malware or harmful code
  • Is illegal, offensive, or discriminatory
  • Violates privacy or publicity rights
  • Contains false or misleading information

5.3 Prohibited Activities

You agree not to:

  • Reverse engineer or attempt to extract source code
  • Use automated systems to access the Platform
  • Resell or redistribute downloaded content without proper licensing
  • Impersonate others or create fake accounts
  • Interfere with Platform security or operations

6. Intellectual Property Rights

6.1 Platform Content

All Platform content, features, and functionality are owned by PsyLoops and protected by copyright, trademark, and other intellectual property laws.

6.2 Sample Licenses

Downloaded samples come with a royalty-free license as detailed in our License Agreement. This license is non-transferable and subject to your subscription status.

6.3 Trademarks

PsyLoops, our logo, and related marks are trademarks. You may not use them without our written permission.

7. AI Services

Our AI-powered services (Sample Generation, Mastering Suite, Composer) are provided "as is." We do not guarantee specific results. You are responsible for reviewing and approving all AI-generated content before use.

8. Third-Party Services

Our Platform may integrate with third-party services (payment processors, cloud storage, etc.). Your use of these services is subject to their respective terms and policies.

9. Disclaimers and Limitations of Liability

9.1 Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted service. We may perform maintenance that temporarily affects availability.

9.2 Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PSYLOOPS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.

10. Indemnification

You agree to indemnify and hold harmless PsyLoops from any claims, damages, or expenses arising from your use of the Platform, violation of these Terms, or infringement of any rights.

11. Dispute Resolution

11.1 Governing Law

These Terms are governed by the laws of California, USA, without regard to conflict of law provisions.

11.2 Arbitration

Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, except for claims that may be brought in small claims court.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or Platform notification. Continued use after changes constitutes acceptance.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
